Mediation
“The settlement is my client…”
The role of a mediator is to be neutral. To not have ‘a dog in the fight,’ as it were. Rather, the role of the mediator is to encourage honest dialogue among the parties, exploring whether resolution of the issues in controversy can be resolved. The mediator’s role is to probe the issues and legal positions of each party, exposing the strengths and weaknesses of their relative positions.
Throughout the mediation process, it is important for the parties to remember that settlement prior to trial saves costs: emotional and fiscal… time and stress.
Scheduling a Mediation
- After the parties have decided to engage in a private mediation, any of the parties should contact Steve (via phone or email) to begin the scheduling process by giving the parties available dates.
- Steve is available for Zoom mediations and in person mediations throughout the country.
Confidentiality
- Parties will agree that the discussions during mediation are confidential.
- The parties understand that the mediator cannot be a witness for any party.
Pre-Mediation Preparation
- Each party will submit a mediation brief five (5) business days prior the scheduled mediation date.
Fees
- $400.00 per hour of preparation (review of the mediation briefs) and mediation.
- Each party will bear its equal % of the mediation fee, unless the parties otherwise agree.
Cancellation
- No cancellation fee if cancelled prior to the submission of the mediation brief deadline. (See above.)
- $800 cancellation fee, if cancelled less than four business days prior the scheduled mediation date (unless rescheduled).
